Lidl and Tesco are in court following a row over Tesco’s use of a circular yellow logo

Lidl has taken Tesco to court over the use of a yellow circle with a blue background, claiming a copyright infringement of its logo. Tesco also uses a yellow circle with a blue background to promote its Clubcard loyalty scheme offers.

The High Court trial began on Tuesday and is anticipated to last for a week, The Guardian reported.

During yesterday’s hearing, lawyers representing Lidl said that Tesco’s action “must involve some form of deception”, despite Tesco claiming it has behaved fairly.

A Tesco counterclaim is “seeking to cancel some of the trademarks in issue”.

Senior members of staff from both retailers are expected to give evidence during the hearing.

Leader of Lidl’s legal team Benet Brandreth KC said: “Tesco deliberately copied Lidl’s branding to achieve precisely the transfer of reputation for good value that is occurring.”

A spokesperson for Tesco maintained: “We continue to strongly defend our position on the basis that our Clubcard Prices logo does not infringe any of Lidl’s intellectual property rights.”
