BHS liquidators bring legal action against Arcadia

The collapsed department store’s holding company, SHB Realisations, has filed documents in the High Court against Sir Philip’s company.

In the documents, which were first reported by the Mail on Sunday, SHB Realisations is listed as the claimant and Arcadia Group, which is behind shops including Topshop and Dorothy Perkins, is the defendant.

No other details about the legal action have been made public.

BHS’ holding company SHB Realisations is in the hands of restructuring firm and joint administrator FRP Advisory, which placed the collapsed retailer into liquidation in December last year to sell the business’s assets in order to pay its creditors.

Duff & Phelps, which was appointed as administrator at the time of the retailer’s collapse, objected to the business being put into liquidation and FRP Advisory being appointed as joint administrator.

However, BHS’ largest unsecured creditor the Pension Protection Fund pressured for the retailer to be put into liquidation.

This is the latest in the ongoing saga of BHS’ collapse and the subsequent fallout, which saw Green pay £363m into its pension fund in February to reduce a £571m deficit.

The department store retailer, which fell into administration last April, put 11,000 employees out of work.
