Marks & Spencer is facing a fresh legal dispute over one of its “Brain Food” snacks.
The retailer is in a legal row following allegations that it copied a nutritionist’s “brain bomb” health snacks.
M&S has been served with legal action regarding its “Brain Balls” product line, which launched last year as part of its Brain Food range.
Its Brain Ball product, manufactured with date paste, was created to be rich in zinc and iron. In its first month, the supermarket sold over 115,000 units of the snacks.
According to The Telegraph, M&S is now facing legal proceedings over the products amid claims they could be mistaken for “Brain Bomb” products by Dorota Cloke, a nutritionist and health coach.
Cloke’s lawsuit focuses on her trademark for Brain Bombs, which she secured in November 2022, following her launch of the product line in 2020. The snacks are manufactured using hemp or sesame seeds and lion’s mane mushrooms.
A court hearing is expected within weeks.
An M&S spokesman told the newspaper: “We do not agree there is any likelihood of confusion between the two products, given that Brain Ball is clearly branded M&S Food, carries our Eat Well sub-brand and the words Brain Ball.
“The Brain Ball was developed by our in-house team as part of our Brain Food range and is not a copy of the Brain Bomb.”
