Green has plans to land a Top Shop flagship store in New York as early as next spring, but the row with New York-based womenswear company Nevada Apparel Corp stymied the push (Retail Week, July 28) as the US business went to court to claim that it owned the Top Shop trademark in the US.
Green told reporters yesterday that the dispute has now been settled and he is to restart the search for a suitable space for the store.
Trademark expert Lee Curtis at UK law firm Pinsent Masons said:'Although it is not clear from reports, it does appear that the matter was settled amicably. Whether that means Arcadia is the only brand allowed to use the Topshop name in the US is open to debate. Either way, Arcadia can now use the Topshop brand in the US.'
Topshop is also set to embark on plans to launch transactional web sites in the US, Ireland and Australia before Christmas.
